This section explains the rules for background screening, who qualifies, what can disqualify someone, and how exemptions work.

Level 2 Screening FAQ

Level 2 screening is a statewide and national fingerprint-based check used to review criminal history. Florida law (Section 435.04, Florida Statutes) requires this screening for employees and contractors in positions of responsibility or trust.
 


  • Fingerprinting: Your fingerprints are checked against both Florida and FBI databases.
  • Criminal history review: Results are reviewed for any disqualifying offenses.
  • Eligibility decision: Only individuals who meet statutory standards may work in covered positions.


Disqualifying Offenses

Some criminal offenses will disqualify you from employment in certain care provider or education roles unless you are granted an exemption.


Examples of Disqualifying Offenses :

  • Violent crimes: murder, manslaughter, aggravated assault, aggravated battery
  • Abuse & neglect: child abuse, elder abuse, neglect of a disabled adult
  • Sexual offenses: sexual battery, lewd or lascivious behavior, exploitation, pornography
  • Kidnapping & human trafficking
  • Arson & burglary (if felony)
  • Serious drug trafficking or fraudulent drug sales
  • Fraud & exploitation (especially involving vulnerable persons)
